Terms of Service

01 — Agreement

By accessing tradestackdigital.com or purchasing any product from TradeStack Digital LLC ("TradeStack Digital," "we," "us," or "our"), you agree to be bound by these Terms of Service. If you do not agree, do not use this site or purchase our products.

02 — Products and Delivery

TradeStack Digital sells digital products — operational documents, SOPs, templates, and systems — delivered electronically via Gumroad and/or email. Upon completed purchase you will receive access to your files via the email address provided at checkout.

  • All products are digital downloads delivered instantly upon purchase confirmation
  • You are responsible for providing a valid email address at checkout
  • Delivery issues must be reported within 7 days of purchase — email support@tradestackdigital.com with your order confirmation number.

03 — All Sales Final

ALL SALES ARE FINAL. Due to the digital nature of our products, we do not offer refunds, exchanges, or credits once a purchase is completed and files have been delivered. By completing your purchase you acknowledge that you have read the product description and understand what you are buying.

If you experience a technical issue with file delivery, contact support@tradestackdigital.com and we will resolve the delivery issue. This does not constitute a refund policy.

04 — License and Permitted Use

Upon purchase, TradeStack Digital grants you a non-exclusive, non-transferable license to use the purchased documents for your own business operations. You may:

  • Customize and implement the documents within your own business
  • Share documents internally with your employees and subcontractors as part of your operations

You may not:

  • Resell, redistribute, sublicense, or share these documents with any third party outside your business
  • Repackage or rebrand these documents as your own product for sale
  • Upload these documents to any public platform, document sharing service, or marketplace
  • Use these documents to create a competing product or service

05 — No Professional Advice

The documents, templates, and systems provided by TradeStack Digital are for informational and operational reference purposes only. They are not a substitute for professional legal, financial, safety, or regulatory advice.

  • No attorney-client relationship is created by purchase or use of these materials
  • TradeStack Digital is not a law firm and does not provide legal advice
  • OSHA standards, employment laws, licensing requirements, and contract enforceability vary by state, municipality, trade, and job type
  • You are solely responsible for ensuring your business operations comply with all applicable federal, state, and local laws

Before implementing any SOP, agreement, or operational procedure, consult with a licensed attorney, certified safety professional, or applicable regulatory authority in your jurisdiction.

06 — Implementation Responsibility

TradeStack Digital provides the documents. Implementation is entirely the responsibility of the buyer. We make no guarantee that any document, system, or process will produce specific results in your business. Outcomes depend on how, when, and whether you implement the materials — factors entirely outside our control.

07 — No Warranty

THE DOCUMENTS IN THIS PACKAGE ARE PROVIDED "AS IS" AND "AS AVAILABLE," WITHOUT WARRANTY OF ANY KIND. TO THE MAXIMUM EXTENT PERMITTED BY APPLICABLE LAW, TRADESTACK DIGITAL DISCLAIMS ALL WARRANTIES, EXPRESS OR IMPLIED, INCLUDING BUT NOT LIMITED TO THE IMPLIED WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, AND NON-INFRINGEMENT.

TradeStack Digital makes no warranty that these documents are complete, accurate, current, or suitable for any specific purpose. Applicable laws and regulations change. OSHA standards are updated. State licensing requirements evolve. Court decisions affect contract enforceability. Employment law changes annually in many states. You are responsible for verifying that any document you use reflects current requirements at the time of use.

08 — Limitation of Liability

TO THE MAXIMUM EXTENT PERMITTED BY APPLICABLE LAW, TRADESTACK DIGITAL LLC'S TOTAL LIABILITY TO YOU FOR ANY CAUSE WHATSOEVER, AND REGARDLESS OF THE FORM OF THE ACTION, WILL AT ALL TIMES BE LIMITED TO THE AMOUNT YOU PAID FOR THIS PRODUCT. THIS LIMITATION APPLIES WHETHER THE CLAIM ARISES IN CONTRACT, TORT, OR ANY OTHER LEGAL THEORY.

TradeStack Digital is not liable for any indirect, incidental, special, consequential, or punitive damages arising from your use of these documents, including but not limited to lost profits, lost business, regulatory fines or penalties, legal fees, or damages resulting from contractual disputes. Nothing in these terms excludes or limits any liability that cannot be excluded or limited under applicable law.

09 — Indemnification

You agree to indemnify, defend, and hold harmless TradeStack Digital LLC and its owner from and against any claims, demands, losses, liabilities, fines, penalties, costs, or expenses (including reasonable attorneys' fees) arising out of or related to your use, modification, or implementation of any document in this package, your operation of your business, or your violation of any applicable law or third-party right. This obligation survives your purchase and use of the product.

10 — Regulatory Compliance

The following categories of law vary significantly by state, municipality, trade, and job type. TradeStack Digital documents do not account for every jurisdiction or circumstance. You are solely responsible for verifying compliance before implementing any document in this package.

Mechanics Lien Law Lien filing deadlines, notice requirements, and procedures vary significantly by state. Missing a lien deadline eliminates your rights permanently.
Tax Obligations Independent contractor classification rules, 1099 requirements, and business tax obligations vary by state and business structure.
Permitting Requirements Permit requirements vary by municipality, trade type, and project scope. Verify requirements before starting any job.

11 — Complete All Bracketed Fields Before Use

Every document in this package contains fields marked with [BRACKETS] that must be completed with your specific information before use. Using any document without completing these fields may result in documents that do not adequately protect your interests or comply with applicable laws.

12 — Intellectual Property

All content on tradestackdigital.com — including but not limited to documents, copy, design, structure, and branding — is the intellectual property of TradeStack Digital LLC and is protected by applicable copyright law. Unauthorized reproduction or distribution is prohibited and may result in legal action.

13 — Third-Party Platforms

Transactions are processed through Gumroad. Email capture and delivery are handled through Kit.com. Your use of these platforms is subject to their respective terms of service. TradeStack Digital is not responsible for the policies or practices of these third-party services.

14 — Governing Law

These Terms of Service are governed by and construed in accordance with the laws of the State of Louisiana, without regard to conflict of law principles. Any dispute arising under these terms shall be brought exclusively in the state or federal courts located in Jefferson Parish, Louisiana, and you consent to the personal jurisdiction of those courts. If any provision is found to be unenforceable, the remaining provisions remain in full force and effect.

15 — Changes to These Terms

We reserve the right to update these Terms of Service at any time. Changes will be posted to this page with an updated effective date. Continued use of the site or our products after changes are posted constitutes acceptance of the revised terms.
